What counts against it: the privacy policy was last updated on 4 May 2023, the data retention period is not published, and the refund policy is restrictive. Privacy: what the terms of use say

The terms of use (version of 23 Jul 2026) say that personal data and chats are kept as long as needed for the service, for the law and for settling disputes. The exact period is not published. The company can also delete generations and chats without notice.

Points worth your attention:

• Messages are not treated as confidential: users or service operators can read what was sent.
• You keep the rights to your bot and your generations, but the company receives a perpetual, irrevocable, transferable license, including for sale and licensing.
• There is no clause about training models on chats, either in the terms or in the privacy policy. That does not prove it does not happen: the information is simply not published.
• The data controller's country is not published in the registry; the operator is Canadian and the governing law is that of Quebec.

To delete, you can remove your account under Profile → Advanced → Delete Account. It is irreversible, and the same email can be used again. Saved chats are deleted one by one under "View Saved Chats"; the help center does not describe bulk deletion. You can also ask support by email to remove your data.

Safety, moderation and minimum age

Adult 18+ content is allowed. Creators of bots with explicit language or images must mark them as NSFW, and the platform also classifies them automatically. In your profile you can hide NSFW bots and blur explicit images.

The terms ban minors in any form, lack of consent, sexual violence, incest, bestiality, real people and deepfakes, hate speech and human trafficking. The community rules also forbid photorealistic explicit content and other people's characters without permission. All faces depicted must be adults.

On age, the minimum is 18. Verification depends on your IP: it is mandatory, for example, in France, the UK, Italy, Australia and several US states. Brazil is not on the list. Where verification applies, it is by video selfie or ID document, handled by outside partners whose names are not disclosed; SpicyChat receives only a yes or no. How age is confirmed in other countries is not described.

On investigations and lawsuits: as of 22 Oct 2026, we found no reports from major outlets about bankruptcy, sale or closure of the company. On the app's status, a notice dated 27 Aug 2025 says Apple removed the app from the App Store. A press release of 1 Apr 2026 mentions 100 million users at the end of 2025, a figure from the company itself with no independent confirmation.

How to cancel SpicyChat AI and what payment involves

To cancel SpicyChat AI, there are 3 steps:

1. Sign in and open your profile.
2. Click "Manage Subscription".
3. On the payment processor page that opens, complete the cancellation.

Access to the plan continues until the end of the paid period. Pay by Bank has no such button because it does not renew. How to cancel a subscription made through Boosty or crypto is not officially described; in that case, contact support. Subscriptions made through the iOS app are valid only until the next renewal date.

Refunds, under the policy of 7 Oct 2026: once the login has been used, there is no refund; not using the subscription or canceling mid-month also gives no right to one. If a refund is made, it goes back to the original payment method within 10 days, after contact with Client Relations. Crypto payments fall outside the policy. Scams and fake apps

The official address is spicychat.ai. The main version is the web one, and on iPhone you can add it to the home screen from the browser. There is no native iOS app. On Android, the official APK is downloaded from a page of the service itself (file spicychat_android_4.7.0.apk) and is not on Google Play.

So be wary of any APK on third-party sites and of stores with a similar name. The page of the old app in the App Store did not open on 22 Oct 2026. Before paying, check the domain, and never send your password or card details through chat, Discord or an email you did not start.
